Judge dismisses three murder charges against Philly abortion doctor

PHILADELPHIA (Reuters) - A Pennsylvania judge dismissed three murder charges on Tuesday against a Philadelphia abortion doctor accused in a high-profile case of killing babies in what was described as a squalid clinic serving low-income women.

Dr. Kermit Gosnell, 72, still faces charges of killing four infants and a woman who underwent an abortion and died at his Women's Medical Society clinic in urban West Philadelphia. He could face the death penalty if convicted.

Common Pleas Court Judge Jeffrey Minehart dismissed three of the murder charges after Gosnell's attorney argued that the prosecution failed to present evidence that the infants had been born alive.

"That is one of the elements (of murder) that the baby is born alive," defense attorney Jack McMahon said.

Prosecutors say Gosnell severed infants' spinal cords after they lived through abortion procedures. They also contend that one patient, Karnamaya Monger, 41, died of an overdose of anesthetics prescribed by Gosnell.

McMahon had argued that all eight murder charges against Gosnell should be dismissed. He also said the law required prosecutors to prove that Gosnell showed a callous disregard for Monger's life to be convicted of murder in that case, and maintained she had received the same medications as other patients.

"How can that be malice? How can that be callous disregard?" he asked.

Gosnell has been in jail since he was charged in January 2011 after a grand jury probe, and faces 23 charges including murder in a case that has rekindled debate in the United States about late-term abortions. Under Pennsylvania law, abortions can be performed up to 24 weeks.

(AP) ? In a rebuttal to the terrorists and a tribute to stellar medical care, all of the more than 180 people injured in the Boston Marathon blasts one week ago who made it to a hospital alive now seem likely to survive.

That includes several people who arrived with legs attached by just a little skin, a 3-year-old boy with a head wound and bleeding on the brain, and a little girl riddled with nails. Even a transit system police officer whose heart had stopped and was close to bleeding to death after a shootout with the suspects now appears headed for recovery.

"All I feel is joy," said Dr. George Velmahos, chief of trauma surgery at Massachusetts General Hospital, referring to his hospital's 31 blast patients. "Whoever came in alive, stayed alive."

Three people did die in the blasts, but at the scene, before hospitals even had a chance to try to save them. A Massachusetts Institute of Technology police officer who police say was fatally shot Thursday by the suspects was pronounced dead when he arrived at Massachusetts General.

The only person to reach a hospital alive and then die was one of the suspected bombers ? 26-year-old Tamerlan Tsarnaev.

But the remarkable, universal survival one week later of all others injured in the blasts is a testimonial to fast care at the scene, on the way to hospitals, then in emergency and operating rooms. Everyone played a part, from doctors, nurses and paramedics to strangers who took off belts to use as tourniquets and staunched bleeding with their bare hands.

As of Monday, 51 people remained hospitalized, three of them in critical condition and five listed as serious. At least 14 people lost all or part of a limb; three of them lost more than one.

Two children with leg injuries remain hospitalized at Boston Children's Hospital. A 7-year-old girl is in critical condition and 11-year-old Aaron Hern is in fair condition.

The surviving bombing suspect, 19-year-old Dzhokhar Tsarnaev, is in serious condition at Beth Israel Deaconess Medical Center with a neck wound.

Flip Frenzy: A unique new puzzle game

We've seen plenty of games that just build off of other proven puzzle concepts, but they often end up being lackluster because you feel they could have been more original. While we like the convenience of shopping the iTunes Store from any device, that doesn't mean we want the download wherever we happen to be -- just ask anyone trying to buy the Beatles Box Set using a flaky coffee shop hotspot. As of a quiet update noticed by Macworld, customers won't have to risk a long wait for some of their impulse purchases. Buy from iTunes on any device and you now have the option to defer very large downloads, whether they're music box sets, movies or TV shows. Shoppers have to live in an area where iTunes in the Cloud is up and running for downloads elsewhere, but that's about the only major catch.
